Adoption is a hugely rewarding and incredibly emotional process.
At Family Solicitors we understand the challenges ahead for all parties concerned.
Adoption is where a child legally becomes a member of a new family and has one or two new parents.
If you are at least 21 years old and can provide a permanent, stable and caring home, your application to adopt will be welcomed.
There is no upper age limit.
Only a court can make an adoption order.
The effect of the adoption order is that the birth parents no longer have any parental rights and responsibilities for their child.
If your marriage or civil partnership has come to an end, then there will often be financial decisions to be made regarding the family home, how to divide up savings, possessions, property and pensions.
If you have any children, there will also be the matter of child maintenance to consider.
If you are unable to agree on how these assets are to be divided, then you may be left with no other option but to apply for a financial order through the courts.
If you are able to agree on how you wish to divide your assets, then the court can also approve this agreement.
A Living Together or Cohabitation Agreement is a legally binding document entered into by both of you to regulate your affairs in relation to money, property, and can also cover children issues, during the time that you are living together and can also deal with what will happen if you split up.
Each of you needs an independent solicitor but the negotiations and discussions are conducted in a friendly and non-hostile way.
Negotiations can either be dealt with through correspondence or at round-table face to face meetings with each of you and your solicitors present.
If you are suffering from abuse you could try to gain some protection from your abuser by applying for a civil injunction or protection order.
A non-molestation order is aimed at preventing your partner or ex-partner from using or threatening violence against you or your child, or intimidating, harassing or pestering you, in order to ensure the health, safety and well-being of yourself and your children.
An occupation order regulates who can live in the family home, and can also restrict your abuser from entering the surrounding area.
The threat of having a child taken into care is most parent's worst nightmare.
Dealing with Social services can be daunting, but certain procedures must be followed before they can remove a child.
As soon as the parents, guardians or carers have received the Pre-proceedings Letter, they are entitled to Legal Aid.
As well as, the advice of a Social Services solicitor who can guide parents through the process.
Your solicitor will also be able to present your case at the Pre-proceedings Meeting.
Prior to the Pre-proceedings Meeting, you will receive reports that you can discuss it with your solicitor.
