We act for clients based overseas, or their partners based in the UK, involved in divorce proceedings in England and Wales.
In order to prove irretrievable breakdown there has to be either a 2-year separation with consent, a 5-year separation without consent, 2 years desertion or allegations of unreasonable behaviour or adultery.
Incompatibility is not acceptable on its own as a basis for divorce.
The grounds for the dissolution of a civil partnership are the same except for the omission of adultery.

Without a financial order, even divorced couples retain unresolved financial claims against each other.
We can help settle or litigate these as effectively and painlessly as possible.
90% of our cases settle before trial, as a result of patient forensic analysis of financial issues and firm negotiation.

Our world map gives an indication of our coverage and experience in every continent (almost!) and across many jurisdictions.
As with any divorce you will need to sort out details such as the division of the finances and assets, and arrangements for any children, not to mention the legal dissolution of the marriage.
Before seeking help from a family law specialist experienced in expat divorce, know what you want to achieve, get your financial affairs in order, you will need to provide a full financial disclosure, so you will need details on earnings, mortgages, investments, pensions, savings and other assets such as cars etc. all handy.
These are agreements made by couples before and after marriage, covering all sorts of issues including detailed finance and sometimes behaviour.
They are sometimes referred to as simply 'prenups' or 'postnups'.
There is no statutory recognition of these agreements yet, but such contracts are increasingly more reliable when divorce proceedings are subsequently initiated.
This particularly applies to older couples with children by previous partners, and those with financial resources which significantly exceed any reasonable needs of both.
