Your Will is the most important document you will ever sign.
It disposes of all of your assets (including your home) after your death.
Despite this, it is estimated that up to 70% of the population do not have a current Will.
Making a Will creates certainty, reduces worry and gives you the peace of mind of knowing exactly how your money, property and possessions will be dealt with after your death.
We are all living longer which increases the risk that at some stage we may become unable to make our own financial or welfare decisions.
Quite rightly no one, not even your husband or wife, has access to your cash, investments or property without your permission.
This can lead to untold expense and worry for your family who would need to make an application to the Court of Protection if you became unable to manage your finances or make welfare decisions through illness or accident.
Unless you've legally given permission to someone you trust to manage your affairs (your attorney), your assets may be frozen unless someone applies to the Court of Protection.
You do not need a solicitor or adviser to make a Lasting Power of Attorney.
All of the forms are available online from the Office of the Public Guardian (www.publicguardian.gov.uk).
However, there are many pages of notes and guidance which should be read carefully before completing the form to ensure that each section of the form is understood.
There are many matters to consider when making a Lasting Power of Attorney and each option has consequences.
The process is rigorous and even the smallest error can render the form void.
Once a property and financial affairs Lasting Power of Attorney has been registered, your attorney(s) can start to make decisions for you - both when you have mental capacity and when you lack mental capacity.
However, you still have authority to act for yourself and your Lasting Power of Attorney does not have to be used straight away.
If you don't want your attorney(s) to act until you lack capacity, you can put a restriction in your Lasting Power of Attorney.
Unlike Lasting Powers of Attorney, Enduring Powers of Attorney do not need to be registered unless you become unable to manage your own financial affairs.
An attorney for personal welfare may make any decision that you could make about your welfare, for example, where you live and with whom, access to your personal information like medical records, deciding what you wear, what you eat and how you spend your day.
They will also be able to give and refuse consent to medical treatment according to you best interests.
Your attorney(s) will only be able to make those decisions where you lack capacity to make them yourself.
Your attorney(s) cannot make decisions about life-sustaining treatment for you unless you expressly say so in your Lasting Power of Attorney.
