Acting for a large London based "craft brewery" in respect of a nationally publicised dawn raid by HMRC and seizure of a substantial quantity of alcohol products due to the alleged non-payment of excise duty and VAT. We represented our client at the police station interview, attended at the seizure and prevented HMRC from seizing some of the stock. We instituted condemnation proceedings in the Magistrates Court against HMRC challenging the legality of the seizure and the circumstances in which it was conducted.

read more › Acted for a large corporate in the First-tier Tax Tribunal against HMRC's denial of input tax in the sum of 12.2m. The appeal raised novel points regarding HMRC's double recovery of VAT and a direct challenge to HMRC's flagship FCIB banking evidence. The appeal was reported as a "tax case that matters" in the Tax Journal. Acted for a successful stock market regulated corporate in respect of HMRC retrospective VAT assessments totalling 97 million in respect of its purchase and sale of European Union Emissions Allowances ("EUAs").

read more › Acted for a group of companies involved in property development and accommodation with a portfolio of more than 500 properties in relation to a complex multi regime HMRC tax investigation. We also acted for the company director, a high-net worth individual, featured in the Sunday Times Rich List, in respect of a personal tax investigation. HMRC made multiple complex tax assessments totaling 8.5m, arising from numerous issues across all tax types including corporation tax, PAYE and VAT. We lodged appeals against HMRC's assessments and successfully reduced the tax liability by 5.2m.

HMRC also refused to remit the Customs Duty pursuant to EU law. Acted for a leading UK customs broker in relation to a dispute concerning goods imported from Thailand. HMRC issued a C18 Post Clearance Demand Notice in the sum of 1.3m. We successfully challenged the legality of the demand with HMRC which led to the C18 being overturned reducing the duty liability to nil.
